II.2.4) Description of the procurement

MHPA wishes to purchase 2 RoRo terminal tractors, with an option to purchase an additional 4 units -Subject to the continuation of our commercial ferry operator agreement. The terminal tractors operate for 10 hours per day over two shifts. MHPA wishes to implement a fleet renewal programme, designed to maintain the highest levels of productivity and safety.

The terminal tractors must be capable of undertaking the RO-RO operation outlined above which operates from Pembroke Port. Delivery of the units would be required under a phased approach as per the quantities and delivery dates shown below

Response to queries 05.09.22
1. Supplier Question: We can only quote in Euro (however we agree to invoice in GBP; currency can either be fixed at point of order or on delivery whichever is preferred by the customer).
MHPA Response: Our preference would be to fix currency at the point of order aligned with rates published by the European Central Bank.

2. Supplier Question: Currently any quote issued will only be valid for 14 days
MHPA Response: MHPA would prefer quotations to be valid at least 21 days and it is our preference that any tractors procured subsequently within the proposed phasing plan are supplied at the same supplier margin. ***Please indicate your supplier margin within the commercial proposal and your ability to retain the same margin for future purchases within the fleet renewal programme.

3. Supplier Question: MHPA Purchasing T&Cs - Point 4.3 – Goods accepted by MHPA on delivery/inspection
MHPA Response: Goods accepted by MHPA on inspection within 72 hours of delivery.

4. Supplier Question 6.1 – all points need further discussions
MHPA Response: Agreed however MHPA require a means to recover any monies paid in the event of non delivery, and or supplier administration.
Suppliers are invited to propose mechanism to recover monies paid in event of default / administration. E.g. provision of a vesting certificate

5. Supplier Question: Once a truck in is production cancellation will have to be discussed it is not an automatic right
MHPA Response: Agreed

6. Supplier Question: 6.1 (c) to (e) subject to negotiation only
MHPA Response As above, a mechanism would need to be agreed to recover monies paid, in the event of non delivery or supplier going into administration.

7. Supplier Question 6.3 & 12 30 days notice of termination
MHPA Response: It is unclear what 30 days notice of termination refers to here

8. Supplier Question 7.3 – our payment terms for capital equipment is full payment prior to delivery and then afterwards for parts it is 30 days net.
MHPA Agreed - providing the points 2, 4 & 5 above can be mutually agreed.
