Lodging of appeals
The Authority will incorporate a minimum 10 calendar days standstill period from the date information on the award decision is communicated to the tenderers and any candidates. This period allows unsuccessful tenderers to seek further debriefing or ask further questions. Such information should be requested from the address of the main contact. If an appeal regarding the award has not been successfully resolved, the Public Regulations 2006 (as amended by the 2009 regulations) provide where aggrieved parties have been prejudiced by a breach of the rules, to take action in the High Court (England, Wales and Northern Ireland. Any action must be brought promptly (generally within 3 months). Where a contract has not been entered into the Court may order the setting aside of the award decision or order the Authority to amend any document and may award damages. If the contract has been entered into the Court may only award damages.
