Wales & West Housing (WWH) is undertaking this procurement exercise on behalf of its wholly owned subsidiary Enfys Developments

Enfys Developments will be contracting party for the purposes of any ensuing contract awarded/let to the successful bidder.

All tender costs and liabilities incurred by bidders shall be the sole responsibility of bidders.

WWH reserves the right to award the contract in whole or in part.

WWH reserves the right to annul the tendering process and not award any contract.

All documents to be priced in GBP and all payments made in GBP.

Bidders should note that they will be required to enter into terms and conditions of contract (Terms) as set out in the procurement pack and that save for matters of clarification or consistency the Terms are non-negotiable

Under the terms of this contract the successful supplier(s) will be required to deliver Community Benefits in support of the authority’s economic and social objectives. Accordingly, contract performance conditions may relate in particular to social and environmental considerations. The Community Benefits included in this contract are outlined in the PQQ.

PQQ Update issued to all Bidders
In relation to questions 1.2b (i) and (ii) at Section 1, Part 1 of the PQQ, WWH recognises that Bidders may not yet be in a position to confirm future sub-contracting arrangements (if any) and furthermore that such arrangements may in any event be subject to change.

Bidders are required to complete questions 1.2b (i) and (ii) , to the extent they are able to at this juncture. For example, if Bidders propose to use sub-contractors but specific arrangements/details are yet to be determined then Bidders should confirm the position accordingly.

Please note that although this section of the PQQ must be completed, it is NOT scored.

Bidders will not be adversely marked down if they not in a position to currently confirm or specify sub-contracting arrangements.

Clarification
It has come to WWHA's attention that there is an error in the methodology set out on pages 10 to 11 of the PQQ in relation to the evaluation of Questions 1a and 1b of Part 3:Section 2- Economic/Financial Standing. The guidance notes in relation to question 1b are hereby updated to read:

"IMPORTANT: Any Bidder who registers any Fail in respect of either of q.1, q.2, or q.3 above will be disqualified from the procurement process. WWHA may make an exception in relation q.1 and the Bidder's profitability if a statement can be provided explaining why the Bidder was not profitable in the most recently completed financial year."

Please note that none of the other guidance notes are amended and this clarification is strictly limited to Questions 1a and 1b of Part 3:Section 2- Economic/Financial Standing
