NHS Kernow (‘the CCG’) is the clinical commissioning group for Cornwall and the Isles of Scilly. Its primary objective is to buy health services for the population of the county and islands including hospitals, mental health services, children"s services and community services. Its annual budget is around GBP 725 000 000 a year.
On the 30.6.2015 Peninsula Community Health Services CIC, the current provider of Community Health Services within Cornwall and the Isles of Scilly, formally advised the CCG that it would not be extending its contract beyond 31.3.2016. The CCG is therefore seeking to transfer for a two year period these services to a capable provider who will work with the CCG over this period of time within the current annual financial cost envelope of GBP 78 268,792 to deliver the services and to redesign the delivery of a community-based model of care. The new contract for these services must commence from the 1.4.2016.
On the 16.7.2015 the Cornwall Devolution Deal was formally signed by Cornwall County Council, Cornwall and Isles of Scilly Local Enterprise Partnership and the CCG. This will enable the CCG to continue to explore closer integration within its health and social care community.
The CCG recognises that moving towards the introduction of devolved budgets through the Case for Cornwall programme, there is every possibility that the provider landscape may change considerably as it realigns budgets and looks for solutions in its economy to reshape traditional health and social care delivery. It is recognised that the Cornwall health economy in its current configuration is unsustainable in the long term.
The CCG will therefore require the provider, over the period of the contract, to work with all existing health and social care providers, the CCG and Cornwall Council to devise a reconfigured model of delivery to create sustainability, to redesign these services and support the transformation in line with the Cornwall Devolution Deal. This is in line with the CCG ethos of integrating health and social care and empowering local communities to have greater ownership of decisions and resources, tailored to local needs.
The provider must be able to demonstrate to the CCG that they can deliver a high quality service and that they have a clear understanding of the strategic direction for services within Cornwall and of the need for close engagement and system leadership with other providers within Cornwall.
The provider will be expected to deliver transferred services within the current financial allocation of GBP 78 268,792 per annum.
The contract value for 2016/2017 is 78 268,792 GBP.
This value includes CQUIN payment which is not guaranteed.
NHS England funding guidelines will apply to any payment made against the services. Current NHS England guidance requires an efficiency within commissioned services after any inflation uplift is applied. An inflator/deflator will be applied to the second year of this contract.
As of the date of this notice it is not known what the national inflator/deflator will be. To be clear the 2017/2018 value will be the sum of 78 268,792 GBP with the national inflator/deflator applied. Again this value includes CQUIN which is not guaranteed.
Due to the urgent and pressing requirement of the CCG to securely transfer these services by the 31.3.2016 to minimise impact to patient care, providers wishing to be considered as a ‘Capable Provider’ for this contract should formally express an interest via In-Tend https://in-tendhost.co.uk/swcsu/aspx/Home by 12 noon on 15.9.2015. Responses will not be accepted by any other means. For the avoidance of doubt, there will not be any further formal advertisement of this opportunity and therefore interested providers must express an interest by the above deadline to be considered.
The Services are health care services and are therefore Part B services for the purposes of the Public Contracts Regulations 2006 (as amended) (the 2006 Regulations). The Public Contracts Regulations 2015 (the 2015 Regulations) set out transitional arrangements and Regulation 120 of the 2015 Regulations confirms that the 2015 Regulations do not yet apply to the procurement of health care services for the purposes of the NHS within the meaning and scope of the
NHS (Procurement, Patient Choice and Competition) (No.2) Regulations 2013) commenced before 18.4.2016.
Consequently, the 2006 Regulations apply to the conduct of the CCG to secure a capable provider of these services. Any assessment process arising out of this Prior Information Notice will be run in accordance with all relevant legislation and guidance as far as it pertains to Part B health care services. For the avoidance of doubt the Commissioner will not be bound by the Public Contracts Regulations 2006, the Treaty on the Functioning of the European Union (TFEU) or any other regulations or legislation except for the specific parts or circumstances that apply directly to the procurement of Part B services. The Commissioner is therefore not bound by many of the formalities and requirements of the 2006 Regulations and reserves the right to vary the form and manner of any capable provider assessment accordingly.
