Ceredigion County Council is inviting tenders for the Supply and Delivery of Groceries to Council establishments including schools and offices within the county. The Framework Agreement will be for a period of 2 years with an option to extend for a further 2 years.

Other particular conditions to which the performance of the contract is subject
1. All food supplied under the agreement must be compliant with current Food Law in every respect.
2. The Public Sector has a duty of care to check food safety and hygiene in order to ensure that there is no risk to the consumer. To ensure that the utmost care is taken with our high risk customer base it will be an essential requirement that all goods supplied under this contract will be subject to an expert Third Party Food Safety Audit Inspection.
3. The successful bidder is required to provide monthly management information as detailed in the e-tender.
4. The successful bidder must be able to provide a range of products from Fairtrade or similar organisations to compliment their full range of products.
5. It is the requirement that the contractor shall permit good hygiene practices, including protection against cross contamination, between and during operation, by foodstuffs, equipment, materials, chemicals, personnel and external sources of contamination such as pests.
6. Allergens
Raw material – It is a requirement of the contract that the contractor (and their agents) should be aware of the hazards arising from contamination by food allergens and conform to the manufacturers’ purchase specification.
Steps should be taken to ensure that non-allergenic ingredients do not come into contact with allergens in subsequent handling and storage.
The contractor must notify the Council’s Catering Service Manager of any changes in the allergen status of the goods they supply.

III.2.1)

Personal situation of economic operators, including requirements relating to enrolment on professional or trade registers
(1) All candidates will be required to produce a certificate or declaration demonstrating that they are not bankrupt or the subject of an administration order, are not being wound-up, have not granted a trust deed, are not the subject of a petition presented for sequestration of their estate, have not had a receiver, manager or administrator appointed and are not otherwise apparently insolvent.
(2) All candidates will be required to produce a certificate or declaration demonstrating that the candidate, their directors, or any other person who has powers of representation, decision or control of the candidate has not been convicted of conspiracy, corruption, bribery, or money laundering. Failure to provide such a declaration will result in the candidate being declared ineligible and they will not be selected to participate in this procurement process.
(3) All candidates will be required to produce a certificate or declaration demonstrating that they have not been convicted of a criminal offence relating to the conduct of their business or profession.
(4) All candidates will be required to produce a certificate or declaration demonstrating that they have not committed an act of grave misconduct in the course of their business or profession.
(5) All candidates must comply with the requirements of the State in which they are established, regarding registration on the professional or trade register.
(6) Any candidate found to be guilty of serious misrepresentation in providing any information required, may be declared ineligible and not selected to continue with this procurement process.
(7) All candidates will be required to produce a certificate or declaration demonstrating that they have fulfilled obligations relating to the payment of social security contributions under the law of any part of the United Kingdom or of the relevant State in which the candidate is established
(8) All candidates will be required to produce a certificate or declaration demonstrating that they have fulfilled obligations relating to the payment of taxes under the law of any part of the United Kingdom or of the relevant State in which the economic operator is established.

Economic and financial capacity
(1) All candidates will be required to provide a statement, covering the 3 previous financial years including the overall turnover of the candidate and the turnover in respect of the activities which are of a similar type to the subject matter of this notice.
(2) All candidates will be required to provide statements of accounts or extracts from those accounts relating to their business.

Under the terms of this contract the successful supplier(s) will be required to deliver Community Benefits in support of the authority’s economic and social objectives. Accordingly, contract performance conditions may relate in particular to social and environmental considerations. The Community Benefits included in this contract are:
The Supplier will work with the Council’s responsible officer to maximise the Community Benefits arising under this Framework Agreement including:
18.1.1 recruiting and training economically inactive persons as part of the workforce delivering the contract;
18.1.2 providing opportunities for SMEs, including social enterprises, to bid for second and third tier supply chain contracts arising out of this Framework Agreement and the Contract;
18.1.3 securing other positive outcomes likely to benefit the local community, including:
- working with local schools and colleges (for example, offering work experience/work placements);
- facilitating environmental initiatives and contributing to community regeneration schemes;
- supporting food banks within the County;
- supplying Fairtrade or similar (in the reasonable opinion of the Council) ethically sourced Products.
18.2 The Supplier will submit to the Council evidence that it has the required expertise or skills to meet these requirements.
The Key deliverable of this agreement is the support to Food Banks, and it is expected that the successful bidder will work with the Council’s responsible officer explore the possibility of maximising the Community Benefits further.
