Abstract

S4C is the only Welsh language television channel and one of the UK's five public service television broadcasters. It is an independent broadcasting authority established under the Broadcasting Act 1981, and regulated by the Communications Act 2003 and the Broadcasting Act 1990. S4C provides a broad range of high quality and diverse programming. The channel airs over 115 hours of Welsh language programming each week. In addition to the above the S4C programme content is available to watch live on the S4C website via broadband and the ‘Clic’ catch up service, via the BBC iPlayer and on YouView, Smart TVs, Sky, Freeview and many other platforms. S4C is uniquely funded through a mixture of grant in aid, commercial revenue and licence fee contribution from the BBC. In addition the BBC supplies ten hours a week of programming funded from the licence fee. S4C wishes to appoint a provider to recruit and administer a panel of members of the public to provide estimates of viewing and audience appreciation data in connection with the S4C programmes. The key elements of the services to be provided are: - The recruitment, management and administration of a panel of at least 1,500 adults made up of 750 Welsh speakers and 750 non-Welsh speakers. - All recruitment must be conducted bilingually in Welsh and English, with Welsh at first contact for Welsh speakers. - The panel members shall all be based in Wales, and the geographical and demographic representation of the panel should reflect that of Wales, with weighting to reflect either census populations or BARB Establishment Survey populations (to be discussed). - The delivery to S4C of a weekly survey capturing consumption of S4C programmes (time spent viewing S4C programmes) and the audience’s appreciation of S4C at a channel level as well as individual programme level. The appreciation indices (AI’s) will be scores out of 100, derived from a 10-point scale. S4C may specify specific questions which the successful tender shall include in the weekly survey. - The delivery to S4C of a general cross-channel appreciation survey once a month (channel appreciation score – up to 10 channels). - The delivery to S4C of a report regarding responses of the panel to supplementary questions once a month. S4C shall nominate the supplementary questions which shall be limited to 3 topics per month. - Each member of the panel shall be contacted bilingually or in the language of their choice, Welsh or English, and all communication & documentation shall be bilingual or in the language of the panellist’s choice. - Surveys shall be conducted in accordance with MRS best practice, no more than 70% shall be conducted online with at least 30% conducted by post. - All panel members shall be 16 years old or older and shall exclude individuals working in the media industry in Wales. - The successful tenderer shall ensure that at least one full time member of staff is a Welsh speaker to provide Welsh language services and deal with any questions or queries from panel members. - The organisation providing the service must abide by the MRS Code of Conduct in relation to the provision of these services to S4C. III.1)

Conditions Relating to the Contract

III.1.1)

Applicants invited to tender will be advised.

III.1.2)

Main Terms of financing and payment and/or reference to the relevant provisions

S4C requires the Viewing and Audience Appreciation Data Service to be provided for a fixed price fee to include set up costs, administrative, staffing, translation and all other costs and expenses incurred by the successful tenderer in providing the service. Tenders should be priced in pounds sterling. Payments will be made in pounds sterling.

Other particular conditions to which the performance of the contract is subject

PQQs are invited from economic operators which are able to demonstrate experience of successfully providing viewing and audience appreciation data services.

Successful tenderers shall ensure that at least one full time member of staff is a fluent Welsh speaker.

III.2)

Conditions for Participation

III.2.1)

Personal situation of economic operators, including requirements relating to enrolment on professional or trade registers


(1) All candidates will be required to produce a certificate or declaration demonstrating that they are not bankrupt or the subject of an administration order, are not being wound-up, have not granted a trust deed, are not the subject of a petition presented for sequestration of their estate, have not had a receiver, manager or administrator appointed and are not otherwise apparently insolvent.

(2) All candidates will be required to produce a certificate or declaration demonstrating that the candidate, their directors, or any other person who has powers of representation, decision or control of the candidate has not been convicted of conspiracy, corruption, bribery, or money laundering. Failure to provide such a declaration will result in the candidate being declared ineligible and they will not be selected to participate in this procurement process.

(3) All candidates will be required to produce a certificate or declaration demonstrating that they have not been convicted of a criminal offence relating to the conduct of their business or profession.

(4) All candidates will be required to produce a certificate or declaration demonstrating that they have not committed an act of grave misconduct in the course of their business or profession.

(5) All candidates must comply with the requirements of the State in which they are established, regarding registration on the professional or trade register.

(6) Any candidate found to be guilty of serious misrepresentation in providing any information required, may be declared ineligible and not selected to continue with this procurement process.

(7) All candidates will have to demonstrate that they are licensed, or a member of the relevant organisation, in the State where they are established, when the law of that State prohibits the provision of the services, described in this notice, by a person who is not so licensed or who is not a member of the relevant organisation.

(8) All candidates will be required to produce a certificate or declaration demonstrating that they have fulfilled obligations relating to the payment of social security contributions under the law of any part of the United Kingdom or of the relevant State in which the candidate is established

(9) All candidates will be required to produce a certificate or declaration demonstrating that they have fulfilled obligations relating to the payment of taxes under the law of any part of the United Kingdom or of the relevant State in which the economic operator is established.

All candidates will be required to produce a certificate or declaration demonstrating that the candidate or any of its directors or any other person who has powers of representation, decision or control over it has been found guilty of any serious misrepresentation in supplying information required of it in relation to a procurement.

The tenderers will be asked to provide the following information in their tender:

i) the tenderer's full name;

ii) the tenderer's registered number (if applicable);

iii) the tenderer's registered office address (if applicable), or, if not applicable, the address of its principal place of trading;

iv) the tenderer's telephone number;

v) the tenderer's fax number;

vi) the name, position, address, telephone number, fax number and email address of the individual within the tenderer's organisation to whom all correspondence should be addressed.

(1) A statement of the candidate's technical facilities; measures for ensuring quality; and their study and research facilities;

(2) An indication of the proportion of the contract which the services provider intends possibly to subcontract.

The applicant will be required to provide the following information:

i) A brief description of the applicant's primary business activities.

ii) Details of the principal services provided by the applicant that are the subject of this tender process as and which have been provided by the applicant during the past five (5) years. Details of the recipients of the services, the dates on which the services were provided and the consideration received for the provision of those services should be included.

iii) A statement as to whether any contracts entered into by the candidate in relation to services similar to those currently being tendered have been terminated due to poor performance of the candidate.

iv) Details of the total number of staff employed by the applicant and the nature of the work they are employed to do.

v) Details of the number of staff with relevant experience and qualifications who would be involved in providing the services including their Welsh language capabilities;

vi) A detailed description of the systems that will be used to deliver the services.

vii) An indication of the type and any work to be sub-contracted and the proportion of the contract that may be sub-contracted and information regarding the experience of the applicant in managing sub-contractors.

Failure to provide all the information requested may preclude the applicant from qualifying to receive an invitation to tender.



Applicants will be required to provide a description of the systems and measures employed by the applicant to ensure quality of service including (for example) adherence to the MRS code of conduct, and whether obtained or seeking to obtain IQCS, ISO 20252, ISO 26362, or other research-related standards certification.

S4C shall not be bound to accept any tender and reserves the right: a) to withdraw from and/or abandon and/or defer this procurement at any time; and/or b) not to award any contract as a result of this procurement.

Freedom of Information

S4C is subject to the provisions of the Freedom of Information Act 2000 ("FOI Act"). Information supplied by any candidate to S4C may be disclosable by S4C under the provisions of the FOI Act. If any candidate considers that any information supplied by it to S4C pursuant to this Contract Notice is commercially sensitive or confidential in nature, this should be highlighted explicitly and the reasons for sensitivity set out in full in the expression of interest. This will enable S4C to take account of such sensitivity or confidentiality in deciding whether to release the information in response to freedom of information requests. However, candidates accept that S4C may disclose such information in response to any request under the FOI Act if S4C determines that it is appropriate to do so.
